WTO Issues Technical Regulations Notifications - May 2006

July 26, 2006

The World Trade Organization (WTO) in May issued notifications of changes to proposed technical regulations by India, Sweden, the U.S., Canada, Dominican Republic and Qatar, addressing generators, fuels, energy conservation and other topics.

The notifications are required under the Agreement on Technical Barriers to Trade (TBT Agreement) and are posted on the National Institute of Standards and Technology (NIST) Notify U.S. web site.

WTO member countries can review and comment on proposed regulations while the regulations are still in the draft stage and subject to revision. The notifications are intended to encourage international transparency, international harmonization of standards and international free trade.

7. Title: Act on cash registers, etc.

8. Description of content:

The cash registers have to be certified by bodies that are accredited in accordance with Act (1992:1119) concerning Conformity Assessment. These bodies will also regularly check that cash registers meet the technical standards. There will be a clause regarding mutual recognition.

  • Every sale and all other use of the cash register have to be registered in the cash register. The customer has to be offered a receipt produced by the cash register on every sale.
  • The cash register has to show what has been registered in a reliable way and also show certain regulated programming and settings.
  • If a machine for credit cards is used it has to be connected to or integrated with the cash register.

7. Title: Technical Amendments to the Highway and Nonroad Diesel Regulations

8. Description of content: EPA is proposing to correct, amend, and revise certain provisions of the Highway Diesel Rule, and the Nonroad Diesel Rule. This action proposes to correct additional errors and omissions from the previous rules, and make minor changes to the regulations to assist entities with regulatory compliance. Further, this action also proposes technical amendments resulting from discussions with various diesel stakeholders. These technical amendments would: provide a temporary increase in the sulfur testing tolerance, revise the designate and track provisions to account for non-petroleum diesel fuels (i.e., biodiesel) and fuel that meets the California Air Resources Board's diesel fuel standards, and amend the alternative defense provisions to account for conductivity additives and red dye. This proposed action is intended to help facilitate compliance with the diesel fuel regulations and ensure a smooth transition to ultra low sulfur diesel fuel.

7. Title: Federal Motor Vehicle Safety Standards; Occupant Protection in Interior Impact

8. Description of content: Our safety standard on occupant protection in interior impact requires, in part, that light vehicles provide head protection when an occupant's head strikes upper interior components, such as pillars, side rails, headers, and the roof during a crash. For altered vehicles and vehicles built in two or more stages, these requirements become effective 1 September 2006. The Recreation Vehicle Industry Association and the National Truck Equipment Association petitioned the agency to permanently exclude certain types of altered vehicles and vehicles manufactured in two or more stages from these requirements. This document responds to these petitions for rulemaking and proposes certain amendments to the standard. Based on a careful consideration of both the safety benefits of the upper interior protection requirements, and practicability concerns relating to vehicles built in two or more stages and certain altered vehicles, we are proposing to limit these requirements to only the front seating positions of those vehicles. Further, we tentatively conclude that it is appropriate to exclude a narrow group of multi-stage vehicles delivered to the final stage manufacturer without an occupant compartment, because of impracticability concerns. We are also proposing to delay the effective date of the head impact protection requirements as they apply to final stage manufacturers and alterers until 1 September 2008.

7. Title: Revision of Fruits and Vegetables Import Regulations

8. Description of content: We are proposing to revise and reorganize the regulations pertaining to the importation of fruits and vegetables to consolidate requirements of general applicability and eliminate redundant requirements, update terms and remove outdated requirements and references, update the regulations that apply to importations into territories under U.S. administration, and make various editorial and non-substantive changes to regulations to make them easier to use. We are also proposing to make substantive changes to the regulations, including: Establishing criteria within the regulations that, if met, would allow us to approve certain new fruits and vegetables for importation into the United States and to acknowledge pest-free areas in foreign countries more effectively and expeditiously; doing away with the practice of listing specific commodities that may be imported subject to certain types of phytosanitary measures; and providing for the issuance of special use permits for fruits and vegetables. These changes are intended to simplify and expedite our processes for approving certain new imports and pest-free areas while continuing to allow for public participation in the processes. This proposal, if adopted, would represent a significant structural revision of the fruits and vegetables import regulations and would establish a new process for approving certain new commodities for importation into the United States. It would not, however, allow the importation of any specific new fruits or vegetables, nor would it alter the conditions for importing currently approved fruits or vegetables except as specifically described in this document. To the extent to which trading partners consider the time it takes to conduct the rulemaking process a trade barrier, by reducing that time, these proposed changes may facilitate the export of U.S. agricultural commodities. The proposed changes would not alter the manner in which the risk associated with a commodity import request is evaluated, nor would it alter the manner in which those risks are ultimately mitigated.

7. Title: Energy Efficiency Program for Commercial and Industrial Equipment: Efficiency Certification, Compliance, and Enforcement Requirements for Commercial Heating, Air Conditioning and Water Heating Equipment

8. Description of content: n a notice of proposed rulemaking published 13 December 1999, (NOPR) the Department of Energy (DOE or the Department) proposed to adopt (1) energy conservation requirements that the Energy Policy and Conservation Act, as amended, (EPCA or the Act) specifically mandated for commercial warm air furnaces, and (2) provisions applying generally to covered commercial heating, air conditioning and water heating equipment, including furnaces, (collectively referred to as "commercial HVAC & WH equipment") to assure their compliance with EPCA requirements. On October 21, 2004, DOE adopted a final rule incorporating the requirements for furnaces but only certain of the general provisions proposed for commercial HVAC & WH equipment. As to the latter, the Department did not adopt the NOPR's proposals for manufacturers to use to determine and certify compliance, and or most of its enforcement proposals, which remain under consideration. These include proposals about manufacturers' use of testing and calculation methods to rate the efficiency of their equipment, the role of voluntary independent certification programs in assuring the accuracy of the ratings, and the testing regimen and criteria that DOE would use in enforcement proceedings, which are the subjects of today's notice. The Department is now soliciting comments on several additional proposed options that DOE is now considering for the rule. In addition, the Energy Policy Act of 2005, Public Law 109-58, (EPACT 2005) created a new category of covered equipment and set forth definitions, test procedures, and energy conservation standards for very large commercial package air conditioning and heating equipment. The Department has codified the definitions and energy conservation standards in Title 10, Code of Federal Regulations, Part 431. 70 FR 60407 (18 October 2005). The Department is applying to that equipment the proposed compliance and enforcement requirements that are the subject of this supplemental notice. (The Department notes that the recent amendments to EPCA set forth in EPACT 2005 do not otherwise affect the issues raised in today's notice.)

7. Title: Energy Conservation Program for Consumer Products: Classifying Products as Covered Products

8. Description of content: Under the Energy Policy and Conservation Act (EPCA or the Act), the Department of Energy (DOE or the Department) is proposing to define the term ``household'' and related terms. 7. Title: Proposed Amendment to the Energy Efficiency Regulations

8. Description of content: The Regulations Amending the Energy Efficiency Regulations (the "amendment") will address recommendations raised by the Standing Joint Committee for the Scrutiny of Regulations pertaining to various sections of the Energy Efficiency Regulations. It will also address issues raised by the Department of Justice on section 11, Verification Mark, of the Regulations.
The amendment will introduce regulatory requirements for beverage vending machines and commercial reach-in refrigeration.
The amendment will increase the stringency of existing minimum performance requirements for three types of air conditioners used in the commercial/institutional sector.
The amendment will update the test method and increase the stringency of energy performance requirements for central air conditioners and heat pumps less than 19 kW (65 000 Btu/h).

This amendment introduces requirements for two new types of appliances: chest freezers with automatic defrost, Type 10A and automatic defrost refrigerator-freezer, with bottom mounted freezer and through-the-door-ice service, Type 5A. The amendment also modifies the definition of automatic defrost system to include the normal compressor cycle as automatic defrost. The amendment will ensure that minimum standard requirements and labelling are harmonized in Canada and the United States for these products.
The amendment will repeal the effective date for internally lighted exit signs. This change will broaden the coverage of the requirement to include all exit signs regardless of the date of manufacture.

The amendment will also repeal the effective date for fluorescent lamp ballasts and introduce ballasts efficacy factors for energy saving lamps. It will also modify specific exclusion criteria for certain ballasts, such as ambient temperature of operation and dimming capabilities. The amendment will also allow for ballasts that operate a small subset of F32T8 lamps to operate at a lower power factor than specified in the current Regulations.

In this amendment, Natural Resources Canada (NRCan) proposes to eliminate the tap range exemption for dry-type transformers.
This amendment will also update the Regulations by adding references to the newly available French version of certain CSA standards, as well as updating the reference of the test method for dishwashers. The amendment will update the numbering system of items included in Part I of Schedule I of the Regulations.
