EC Takes Action Against Greece Over Euratom Directive
November 24, 2009 // Published as a news service by IHS
The deadline for the transposition of this directive was Dec. 25, 2008.
After having given Greece the opportunity to submit its observations belatedly and receiving no response, the EC launched the second phase of the infringement procedure.
The applicable directive, which replaces Directive 92/3/Euratom, continues a system of control and prior authorization for transboundary shipments of radioactive waste, both to protect the health of workers and the public and to avoid illicit traffic of such materials.
The directive improves and simplifies the existing consent procedure and ensures that countries of destination and transit are informed about transfers of radioactive waste or spent fuel to or through their countries.
The dispatch of a reasoned opinion is the second phase of an EC infringement procedure. If Greece fails to notify the EC of the transposition of the directive into national law within the set deadline, the EC may refer the matter to the European Court of Justice.
